Q: What is the Energy Policy Act of 2005?

A: The Energy Policy Act of 2005 (EPAct) offers businesses federal tax deductions, through December 2013, for purchasing energy-efficient lighting systems that provide lower energy bills and meet certain criteria.

Q: What are the EPAct requirements and who qualifies?

A: Commercial property owners or system designers are allowed a one time tax deduction for energy-efficient lighting systems that are installed during construction or as a retrofit (lighting upgrade) into existing structures. The systems must reduce annual energy and power consumption by a minimum of 25% (=0.225 watts / sq. ft.) to maximum 40% (=0.18 watts / sq. ft.) as compared to the American Society of Heating, Refrigerating, and Air Conditioning Engineers (ASHRAE) 2001 standard (0.30 watts / sq. ft.)

Q: How much would all our projects qualify for maximum deduction?

A: The deduction would equal the cost of the entire system installed during new construction, with a maximum deduction of 60 cents per square foot of the building or allows for a deduction in existing building retrofits of 60 cents per square foot or the total net project cost, whichever is the lesser of the two amounts.
